When DCR Says Your Abandoned License Missed Its Window

We're increasingly hearing from operators who assumed an abandoned cultivation or retail record still had time on the clock to refile — only to have DCR come back and say the record is no longer eligible. It's a pattern showing up across a number of licenses for various, often similar, reasons.

The setup is usually the same: a license that was never operational — no activity, no revenue — goes dormant. The Office of Finance shows a clean account, nothing owed. So the operator reasonably assumes an inactive license with a clean Finance record should still be refileable.

DCR's review can turn up something different. A record can be marked abandoned for unpaid Annual License Application (ALA) fees — a separate obligation from anything owed to the Office of Finance, invoiced as a condition of renewal. If those ALA fees were never paid, the fee is never "deemed filed." Under LAMC 104.06(a)(iv), that makes the record ineligible for refiling — regardless of a clean Finance balance.

A related and independent issue shows up under LAMC 104.06(a)(i): a record that never reached Temporary Approval status before being deprecated is barred from refiling on that basis alone.

The real-world consequence: this kind of finding can be enough to unwind a live transaction — a buyer's diligence turns up that the license everyone assumed was available for sale, isn't.

The one piece of good news: a license holder in this position is typically still eligible to submit a brand-new pre-application at a different address for activities they remain eligible for. Cultivation specifically is expected to reopen to general public filing pending City Council confirmation.

The takeaway for anyone sitting on a dormant license: "the city owes me nothing" and "DCR says I'm current" are two different things. If a license went inactive, check the ALA fee status directly with DCR — not just your Office of Finance balance — before assuming you still have time to refile.
